This Privacy Policy explains how Jacob Mark, operating as Life Rich Coaching™ (“we,” “us”), collects, uses, protects, and discloses personal information. It applies to this website, our coaching services, and any programs or products we offer.
Your privacy matters to us. We follow the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable Canadian privacy legislation.
1. Our Principles
We follow the ten principles set out in PIPEDA:
Accountability: we are responsible for the information under our control.
Identifying purpose: we make clear why we are collecting information before or at the time we collect it.
Consent: we obtain your consent before collecting, using, or disclosing your personal information, except where the law requires otherwise.
Limiting collection: we collect only what is necessary for the purpose identified.
Limiting use, disclosure, and retention: we use information only for the purpose it was collected and keep it only as long as needed.
Accuracy: we keep information as accurate and current as necessary for its purpose.
Safeguards: we protect information with security appropriate to its sensitivity.
Openness: we are open about our practices.
Individual access: you may request access to the information we hold about you and have it corrected.
Challenging compliance: you may raise any concern about how we handle your information.
2. Consent
By providing us with your personal information, you consent to its collection, use, and disclosure as described in this policy. We will never ask you to consent to uses beyond what is explained to you at the time of collection.
You may refuse to provide personal information, and you may withdraw consent at any time by writing to jacob@jacobmark.com. Please note that some information is necessary to deliver coaching safely — for example, health screening information — and withdrawing consent for that information may mean we can no longer provide the coaching services. We will always discuss this with you rather than simply ending the relationship.
3. What We Collect and Why
Website visitors
Mailing lists: if you subscribe to a mailing list or newsletter, we collect your email address and, where you provide it, your name. This is used to send you the communications you signed up for. You may unsubscribe at any time using the link in any email.
Enquiries: if you contact us through the website or by email, we collect your name, email address, and whatever you choose to tell us, so that we can respond.
Coaching applicants
Application form: if you apply for coaching, we collect your name, email address, and your answers about your goals, current situation, and what you are looking for. This is used to assess fit and prepare for a discovery call.
Coaching clients
Once you become a client, we collect considerably more, because coaching you safely requires it:
Identity and contact: name, email address, mailing address, and date of birth.
Health information: health screening answers, injuries, diagnosed conditions, medications, and any information you share about your relationship with food or eating history. This is sensitive personal information and is treated accordingly. It is used solely to design and adjust your program safely and to determine whether medical clearance is required.
Training and progress data: body weight, measurements, progress photographs, training logs, food logs, sleep and step data, check-in responses, and coaching notes. This is used to track progress and adjust your program.
Payment information: we do not store your full payment card details. Payments are processed by third-party providers who handle card data directly. We receive confirmation of payment and basic transaction records.
Communications: messages, call notes, and correspondence throughout the coaching relationship.
Cookies
Our website uses cookies — small pieces of information exchanged between the website and your device. Cookies allow the site to remember information you have entered, keep items in a shopping cart between pages, and help us understand how the site is used so we can improve it. Most browsers allow you to refuse or delete cookies through their settings.
4. Health Information — Additional Protections
How we treat health data
Health information you provide is used only to design and adjust your coaching program safely, and to determine whether physician clearance is required before training begins.
It is never sold, never used for marketing, and never shared with third parties except: (a) with your written permission, (b) where required by law, or (c) where there is a reasonable concern of serious harm to you or to another person.
Progress photographs, measurements, results, and testimonials are never shared publicly without your explicit written permission, given separately. That permission can be withdrawn at any time in writing.
Please note that the coaching relationship is not a legally privileged relationship in the way that the medical or legal professions are. Communications with your coach are not subject to legal privilege.
5. Third-Party Services
We use third-party platforms to run the business and deliver coaching. Where information is shared with them, it is only what is necessary for them to perform their function. Each has its own privacy policy, and we encourage you to review them.
Website and checkout: Squarespace — hosts jacobmark.com and processes orders.
Payment processing: Stripe and any instalment financing provider offered at checkout — process payments and hold payment card details directly. We do not store full card numbers.
Coaching application: Everfit — delivers your training program and holds training logs, habit tracking, check-ins, progress photographs, and messages.
Forms: Google Forms and Google Drive — collect and store application and onboarding responses, including health screening information.
Email: Flodesk and Squarespace — sends newsletters, welcome sequences, and client communications.
Scheduling: Calendly — books calls and holds your name, email, and appointment details.
Documents and signatures: Adobe — handles the coaching agreement and electronic signatures.
Some of these providers store data outside Canada, including in the United States. Information stored in another country may be accessible to that country’s law enforcement and regulatory authorities under its laws.
We are not responsible for the privacy practices of third-party websites you may be directed to. We encourage you to read their policies before providing personal information.
6. How We Protect Your Information
Access to client information is limited to Jacob Mark. We do not have staff or contractors with access to client health data.
Accounts holding client information are protected by strong, unique passwords and, where available, two-factor authentication.
We use reputable providers who apply industry-standard encryption in transit and at rest.
No method of transmission or storage is completely secure. While we take reasonable steps to protect your information, we cannot guarantee absolute security.
7. How Long We Keep Information:
Mailing list data: Until you unsubscribe. Your email may be retained on a suppression list so that we do not contact you again.
Application data (not proceeding): Up to 12 months, then deleted.
Client records including health information: For the duration of the coaching relationship and for a period afterwards, in case of any question or claim relating to the services provided. Deleted or anonymised after that period.
Financial records: As required by Canadian tax law.
Progress photographs: Deleted at your request at any time.
8. Your Rights
You may at any time:
Ask what personal information we hold about you and request a copy.
Ask us to correct anything inaccurate or incomplete.
Ask us to delete your information, subject to any records we are legally required to keep.
Withdraw consent for marketing communications, or for the use of your photographs or testimonials.
Raise a concern about how your information has been handled.
Requests can be sent to jacob@jacobmark.com and we will respond within 30 days.
If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada.
9. Children
Our services are intended for adults. We do not knowingly collect personal information from anyone under 18. Coaching clients must be 18 or older.
10. Changes to This Policy
This policy will be updated as our business and website change. The date of the most recent update appears at the top of this page. We do not send notifications of changes, so please review it periodically.
